Terms of Service

These Terms of Service ("Terms") govern your access to and use of ChatGPT Image, including chatgptimage.co, related websites, products, features, AI image generation services, credit packs, and any related tools or services we provide.

By accessing or using ChatGPT Image, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the service.

ChatGPT Image is a third-party creative tool and is not affiliated with OpenAI or ChatGPT.

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use ChatGPT Image.

By using the service, you represent that:

you are legally able to enter into these Terms;
the information you provide is accurate and current;
you will keep your login credentials secure;
you are responsible for all activity under your account;
you will promptly notify us if you believe your account has been compromised.

We may refuse registration, suspend accounts, or terminate access if we believe an account violates these Terms, creates risk, or is used for abuse, fraud, or unlawful activity.

2. Our Service

ChatGPT Image provides AI-assisted tools for generating, editing, managing, and downloading image outputs from prompts, uploaded files, reference images, and related inputs.

The service may include:

text-to-image generation;
image editing or image-to-image workflows;
prompt enhancement or prompt assistance;
image history, downloads, and output management;
paid credit packs and usage-based generation;
related website features, APIs, or tools.

We may update, modify, add, remove, suspend, or discontinue any part of the service at any time. We do not guarantee that any specific feature, model, provider, generation mode, output format, or pricing option will remain available permanently.

3. Third-Party Status and Brand Disclaimer

ChatGPT Image is not an official OpenAI, ChatGPT, Midjourney, Google, or other third-party product.

References to "ChatGPT," "GPT," "OpenAI," "Midjourney," "Google," model names, or other third-party names are for descriptive, comparison, compatibility, or informational purposes only. They do not imply sponsorship, endorsement, partnership, authorization, or affiliation unless expressly stated.

You must not use our service or content in a way that falsely suggests endorsement by ChatGPT Image, OpenAI, Midjourney, Google, or any other third party.

4. User Content

"User Content" means prompts, text, files, reference images, uploaded materials, settings, instructions, feedback, support messages, and other content you submit to the service.

You retain any rights you have in your User Content. However, by submitting User Content, you grant ChatGPT Image a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, display, and use the User Content as necessary to:

provide and operate the service;
generate, edit, store, and deliver outputs;
provide support and troubleshoot issues;
prevent abuse, fraud, and security incidents;
enforce these Terms;
comply with legal obligations;
improve the service where permitted by law and our Privacy Policy.

You represent and warrant that you have all rights, permissions, and legal authority necessary to upload, submit, and use your User Content.

Do not upload or submit content that you do not have the right to use.

5. Generated Outputs

"Generated Outputs" means images, files, metadata, prompt results, or other materials generated by the service in response to your User Content.

Subject to these Terms and applicable law, you may use Generated Outputs for personal or commercial purposes. However, you are solely responsible for reviewing and using Generated Outputs lawfully.

You understand and agree that:

AI-generated outputs may be inaccurate, incomplete, offensive, unexpected, low quality, or unsuitable for your intended purpose;
outputs may not be unique and similar or identical outputs may be generated for other users;
we do not guarantee exclusivity, originality, copyrightability, ownership status, non-infringement, accuracy, or fitness for a particular purpose;
outputs may require human review, editing, legal review, or brand review before use;
you are responsible for ensuring outputs do not violate laws, third-party rights, platform rules, or applicable policies.

Do not rely on Generated Outputs for legal, medical, financial, employment, housing, insurance, credit, safety-critical, or other high-impact decisions.

6. Acceptable Use

You agree not to use ChatGPT Image to:

violate any law, regulation, court order, or third-party right;
upload, generate, or distribute infringing, unlawful, deceptive, defamatory, harassing, hateful, abusive, exploitative, or harmful content;
upload content you do not have the right to use;
impersonate another person or misrepresent affiliation, endorsement, or identity;
generate or distribute non-consensual intimate imagery, sexual exploitation, or content involving minors;
generate or distribute content that promotes violence, terrorism, self-harm, or illegal activity;
generate fraudulent documents, deceptive ads, scams, phishing content, fake endorsements, or misleading impersonations;
create content that violates publicity, privacy, trademark, copyright, or other intellectual property rights;
use outputs involving real people in ways that could materially affect legal, financial, educational, employment, housing, insurance, medical, or safety outcomes;
interfere with, disrupt, overload, scrape, reverse engineer, or attempt unauthorized access to the service;
bypass usage limits, rate limits, credit systems, security systems, payment systems, or access controls;
resell, transfer, automate, or exploit credits or accounts without permission;
use the service to train competing models or extract system behavior unless we expressly allow it.

We may investigate and remove content, restrict generations, suspend accounts, or terminate access if we believe these rules have been violated.

7. Credits, Billing, and Payments

Some features require paid credits or paid access. By purchasing credits or paid services, you authorize us and our payment providers to charge the listed amount, including applicable taxes, fees, and currency conversion charges.

Credits are subject to the pricing, usage, and generation rules shown at the time of purchase. Unless otherwise stated:

credits are digital goods;
credits have no cash value;
credits are not a bank account, stored value account, or currency;
credits are not transferable unless we expressly allow it;
credits may be consumed when an image generation, edit, or related AI operation is initiated or completed under the applicable usage rules;
credit cost per generation may vary by mode, model, feature, resolution, or product settings;
promotional, bonus, referral, trial, or complimentary credits may have separate limits.

We may change pricing, credit packages, free trial limits, generation costs, and paid features at any time. Changes will not retroactively reduce credits you already purchased unless required by law or necessary to prevent abuse or fraud.

8. Refunds

Refunds are governed by our Refund Policy.

Because ChatGPT Image sells digital credit packs and related AI generation services, purchases are generally non-refundable once credits have been used.

You may be eligible for a refund if you request it within 7 days of purchase and none of the paid credits from that purchase have been used, or if there is a verified duplicate charge, failed credit delivery, or billing error.

9. Taxes

You are responsible for any taxes, duties, levies, or government charges that apply to your purchase or use of the service, except for taxes based on our income.

Where required, taxes may be calculated and charged at checkout by us or our payment providers.

10. Third-Party Services and Providers

ChatGPT Image may rely on third-party providers for hosting, storage, payments, authentication, analytics, security, email, customer support, AI infrastructure, and image generation.

Your use of the service may involve third-party systems, APIs, model providers, payment processors, or infrastructure providers. We are not responsible for third-party service outages, policy changes, pricing changes, data processing, or platform restrictions except as required by law.

Third-party services may be subject to their own terms and privacy policies.

11. Intellectual Property

ChatGPT Image and its software, design, branding, logos, website content, interfaces, features, documentation, and related materials are owned by us or our licensors.

These Terms do not grant you ownership of:

the ChatGPT Image platform;
our software, code, infrastructure, or interface;
our brand, logo, domain, or trademarks;
our site content, documentation, templates, or proprietary materials;
any third-party trademarks, model names, or brand assets.

You may not copy, modify, distribute, reverse engineer, resell, or create derivative works from our platform except as expressly allowed by law or by us in writing.

12. Copyright and Infringement Complaints

If you believe content available through ChatGPT Image infringes your copyright, trademark, publicity rights, or other rights, contact us at support@chatgptimage.co.

Your notice should include:

your name and contact information;
identification of the work or rights you claim are infringed;
the URL, image, account, or material at issue;
a statement explaining why you believe the use is unauthorized;
any supporting documentation;
a statement that the information you provide is accurate.

We may remove or restrict content, suspend accounts, or take other appropriate action in response to valid complaints.

13. User Responsibility for Commercial Use

If you use Generated Outputs for commercial, public, client, advertising, product, editorial, or paid purposes, you are responsible for reviewing the output before use.

You should check for:

trademarks, logos, and brand assets;
copyrighted characters or protected works;
recognizable people, likeness, or publicity rights;
misleading claims or endorsements;
inaccurate, offensive, or harmful content;
platform-specific advertising, marketplace, or publishing rules;
disclosure requirements for AI-generated content.

We do not provide legal clearance for Generated Outputs.

14. Service Availability

We try to keep ChatGPT Image available and functional, but we do not guarantee uninterrupted, secure, or error-free service.

The service may be unavailable, delayed, degraded, or limited due to maintenance, updates, provider outages, model availability, traffic, abuse prevention, security issues, payment issues, or events beyond our control.

We are not responsible for lost prompts, lost outputs, delayed generations, unavailable features, or temporary loss of access except as required by law.

15. Beta Features and Experimental Tools

Some features may be beta, experimental, preview, or limited-release features. These features may be unstable, inaccurate, incomplete, changed, suspended, or discontinued at any time.

You use beta or experimental features at your own risk.

16. Disclaimers

To the maximum extent permitted by law, ChatGPT Image is provided on an "as is" and "as available" basis.

We disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

We do not guarantee that:

the service will be uninterrupted, secure, or error-free;
outputs will be accurate, unique, original, legal, non-infringing, or suitable for your intended use;
prompts will produce expected or consistent results;
generated images will meet your creative, commercial, technical, or legal requirements;
any model, provider, feature, price, or generation mode will remain available.

Some jurisdictions do not allow certain disclaimers, so some of these disclaimers may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, ChatGPT Image, its owners, operators, employees, contractors, service providers, and affiliates will not be liable for:

indirect, incidental, special, consequential, exemplary, or punitive damages;
loss of profits, revenue, data, goodwill, business opportunity, or expected savings;
damages related to generated outputs, failed generations, account suspension, service interruption, or third-party claims;
damages caused by third-party providers, payment processors, AI infrastructure providers, or user misuse.

Our total liability for any claim arising out of or relating to the service will not exceed the greater of:

the amount you paid to ChatGPT Image in the 12 months before the event giving rise to the claim; or
USD $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ChatGPT Image, its owners, operators, employees, contractors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

your use of the service;
your User Content;
your Generated Outputs;
your violation of these Terms;
your violation of law or third-party rights;
your commercial use of outputs;
your misuse of credits, accounts, or payment systems.

19. Suspension and Termination

You may stop using ChatGPT Image at any time.

We may suspend, restrict, or terminate your access to the service if we believe:

you violated these Terms;
you violated applicable law;
you created legal, security, payment, fraud, or abuse risk;
your account was involved in chargeback misuse or payment disputes;
your use could harm the platform, other users, third parties, or our service providers;
we are required to do so by law or by a service provider.

Termination may result in loss of access to your account, prompts, outputs, credits, and generation history. Refund eligibility after suspension or termination is governed by the Refund Policy and applicable law.

20. Changes to the Service or Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date.

If changes are material, we may provide additional notice through the site, account dashboard, email, or other reasonable methods.

Your continued use of ChatGPT Image after changes become effective means you accept the updated Terms.

21. Governing Law and Disputes

These Terms are governed by the laws applicable to the operator of ChatGPT Image, without regard to conflict-of-law principles, unless mandatory consumer protection laws require otherwise.

Before filing a legal claim, you agree to contact us at support@chatgptimage.co and try to resolve the dispute informally. We will make reasonable efforts to respond and resolve the issue.

If a dispute cannot be resolved informally, it will be handled in the courts or dispute resolution forum with proper jurisdiction, unless applicable law provides otherwise.

22. Miscellaneous

If any part of these Terms is found unenforceable, the remaining parts remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.

These Terms, together with the Privacy Policy, Refund Policy, and any additional terms shown at checkout or in the service, make up the entire agreement between you and ChatGPT Image regarding the service.
